Legal action in the courts to protect the North Devon Coast Area of Outstanding Natural Beauty (“AONB”) in Croyde Bay from harmful development and/or impacts on the natural environment. Making representations on certain planning and other applications which may be viewed as having a harmful impact on the AONB and/or the environment. Promotion of the AONB and environmental issues in Croyde and its surrounding area (Georgeham Parish) via CARA developed websites, social media and/or activities to generate public interest and support. Commissioning videos to assist with this. Contributions through volunteer work and fundraising and grants towards community assets and services. For example, new community footpath/fence for a community footpath, helping to procure, locate, install and maintain defibrillator equipment in the community, local community food bank collection and volunteer work relating to distribution and assistance to members of the community. Carrying out community activities such as local choir, Christmas carols, monthly community teas and other community related events.

The Trustees declare that during the Trustee Annual Report Period 1 January to 31 December 2021 inclusive they have had regard to the Charity Commission’s public benefit guides PB1, PB2 and PB3 in relation to CARA’s objectives, activities, operations and reporting.

Summary of the main achievements of the charity during the year

High Court and Court of Appeal legal action

The legal action commenced in the High Court by CARA in July 2020 and referred to in last year’s Trustee’s report continued throughout 2021, finally coming to a conclusion at the end of the year. Following CARA’s success in the High Court in March 2021 to overturn an unlawful and harmful planning permission, the court case continued. The interested party sought leave to appeal from the High Court Judge which was refused. The interested party then sought leave from the Court of Appeal which was granted. CARA was involved in obtaining legal representation on both applications for leave to appeal and then in representing its case at the Court of Appeal. This involved lodging various documents at the Court of Appeal, obtaining a consent order on limitation of costs and reviewing and commenting on documents lodged by the appellant relating to the appeal. Court of Appeal Hearing dates were set for January 2022. CARA fund raised to meet these legal costs and the anticipated costs and potential liabilities of the Court of Appeal hearing dates in January 2022, to secure legal representation for the hearing before the Court of Appeal. It was necessary to secure sufficient funds to cover the costs and liabilities in relation to the court case through crowd funding and other fundraising initiatives as CARA has no other resources to meet such costs and liabilities. The legal costs for the court case run in the tens of thousands of pounds. The funding generated by membership fees is well under £1000 per annum. A Crowd funding website (Crowd Justice) was used to raise funds as were websites, Instagram and twitter accounts set up by CARA. There was a Croyde Village Green campaign during the autumn school holidays to raise the profile of the court case and its issues. Funds raised through collections, tombola, raffle (with prizes being donated by local businesses and residents),kids crafts and banners and posters and leaflets being handed out to visitors, tourists and the local community. Shortly after this and prior to the Court of Appeal Hearing dates, the appellant withdrew their appeal and agreed to contribute towards CARA’s legal costs. CARA accepted the appellants offer that if CARA donated its legal costs of up to £35, 000 towards community projects, the appellant would match fund this sum. CARA has agreed to do this on the basis that any community projects it contributes to comply with the objects of the fund it set up to finance the legal action. A grants programme is being set up for commencement in Spring 2022 for funding towards community projects in the locality.

Applications affecting the AONB/the natural environment CARA has engaged legal representatives and specialists to make representations to the local authority on a couple of applications that could have a significant impact on the AONB and/or the natural environment

Community assets and events

CARA has assisted with fundraising and grants for various community projects and initiatives. For example, it secured funding towards a fence for the new footpath in the playing fields at Georgeham to stop cars obstructing the foot path. The Georgeham & Croyde Caring Community Group have started up

monthly afternoon tea sessions in the Village Hall Croyde for the community and are looking to expand this to Georgeham Village Hall in 2022. CARA assisted with an application to Jay’s Aim Charity to secure a defibrillator being located at Down End Car Park at the southern end of Croyde Bay. CARA provided Christmas Carol singing and festive drinks for the community in December 2021.

With the lifting of covid restrictions CARA is looking to commence more of its usual social fundraising activities and will be holding a couple of Jazz Cafes in the first half of 2022.

CARA does not have any employees. All its activities and operations are performed by volunteers from the local community. It is solely dependent on volunteers, fund raising and its membership fees, for this. It does not spend money or incur liabilities where it does not have the funds to meet the expenditure or liabilities concerned.

The High Court ruled in favour of the CARA in March 2021 and although Parkdean subsequently sought leave to appeal to the Court of Appeal, they withdrew this in November 2021. The acounts reflett all of the legal and campaign costs incurred by C4RA, the fund raising received over the two years and the contribution received towards the legal costs from Parkdean and Nt)DC following the High Court decision. A further cost contribution of £8107 was received from Parkdean in January 2022 relating to CARA'S legal costs incurred for the appeal. These funds will be reflected in the 2022 accounts.
