Qn 27 June 2019 the Suprerne Court denled the 8o¥ernment permission to appeal the C￿rt ol Appears lud8ment that
transl¢lMal prov￿1￿$ iNtroduced to the reformed penslon schemes In 2015 gave rlse to unlawful age discdmlnztion. 7he
government is respecting the Court's declslon and has 5ald It will enBage ful￿ wlth thè Employment Tribunal as well as
emplf>yer and ￿￿rnber reP￿Entat￿e$ tv a8ree howthe dlscriminations will be rernedied.
The TPS Is subject to a cost cap methantsm whlch was put in placè to protect taxpayers against unfore5ten thanges in
scherne CDSts. The Chief 5ecretaryto the Treasury, hawn8 in 2018 announced that there would be a review of this cost cap
mechanism. In january 2019 announod a pause to the cost cap mechanism f¢llowin8 the Court of Appeal's ruling in the
mcc1r￿dIsar9eènt casé and until there ts ￿rtaInty aboutthe value of penslons to employees from April 2015 onwards.
In view of the above rulln85 and deLi5ions the a55umptlons wed In the 31 March 2016 Actuadal Valuafion may become
inappropri*e. In this scenario, a valuation prepared in aECoTdan￿ with revised benefits and suliably rev15ed assumptlons
w￿aId yleld different ￿sU￿$ thaTh those ￿ntained In the Artuarial Valuation.
