TRUSTEE’S REPORT

FOR THE YEAR ENDED 5 APRIL 2025

The trustee presents their report with the accounts for the year ended 5 April 2025.

The accounts have been prepared in accordance with the Charity Commission for England and Wales Introductory Notes for Receipts and Payments Accounts (June 2013: new format January 2017).

The trustee confirms that they complied with the duty in Section 4 of the Charities Act 2011 to have due regard to the Charity's Commission general guidance on public benefit "Charities and Public Benefit". The Trustee’s Report clearly sets out the charitable objectives, current activities and how they benefit the public.

STRUCTURE AND GOVERNANCE

Governing document

The charity is governed by the Will of the settlor dated 14 December 1954.

OBJECTIVES AND ACTIVITIES

The fund was first set up on the death of the settlor to pay or apply the income and capital, as grants, for such charitable purposes as the then trustees should in their absolute discretion determine.

Charitable Objects and the Advancement of Public Benefit

There are no restrictions in the Will Trust itself, other than in respect of grants to individuals. In the past the former trustees gave priority to charities which existed for the benefit of causes which were of the greatest interest to the late Lord Egerton, namely:

On 19 April 2011 the trustees resolved by way of grant to transfer the property of the charity, consisting of its investment portfolio and cash, to Barnardo’s. They subsequently retired as trustees in favour of Barnardo’s, which now administers the charity. The trustee will continue to receive, from time to time, payments in respect of releases of restrictive covenants arising from land formerly part of the Will Trust. No other assets are held, as far as the Trustees are aware.

The trustee has paid due regard to guidance issued by the Charity Commission in deciding what activities the charity should undertake.

FINANCIAL REVIEW

Overview

During the year the charity received one income payment into the fund of £200,000 (2024: £150,000). The trustee exercised their discretion in favour of Barnardo’s and recorded this in accordance with the Charity Commission Order dated 24 October 2008.

The net movement of funds in the year was £0 (2024: £0).

I report to the charity trustee on my examination of the accounts of Lord Egerton of Tatton Will Trust for the year ended 5 April 2025 which comprise the Statement of Financial Activities, the Balance Sheet and the related notes.

Responsibilities and basis of report

As the trustee of the charity you are responsible for the preparation of the accounts in accordance with the requirements of the Charities Act 2011 (‘the Act’). I report in respect of my examination of your charity's accounts as carried out under section 145 of the Act. In carrying out my examination I have followed the Directions given by the Charity Commission under section 145(5)(b) of the Act.

I have completed my examination. I can confirm that no material matters have come to my attention in connection with the examination giving me cause to believe that:

1 Accounting Policies

Charity information

The charity is an unincorporated trust registered with the Charity Commission (No. 272973) since 14 March 1977. The registered office is Barnardo’s, Tanners Lane, Barkingside, ILFORD, IG6 1QG.

Accounting convention

The charity’s annual gross income is less than £250,000 and Receipts and Payments Accounts have been prepared in accordance with the charity’s constitution and the Charities Act 2011.

5 RELATED PARTIES

Under a Section 26 Order dated 24 October 2008, Barnardo’s was authorised by the Charity Commission for England and Wales to act as trustee of the Egerton Will Trust.

Barnardo’s is the sole trustee of the charity.

During the year distributions totalling £200,000 (2024: £150,000) were made to Barnardo’s.

During the year Barnardo’s paid £366 to the charity to cover the cost of the Independent Examination (2024: £360 covering 2 years).

The charity does not hold funds.

When funds were released to Barnardo’s by the previous trustees, £30,000 was reserved by Barnardo’s for any future expenditure which might be incurred, such as legal or accountancy fees.
