Chairman’s Report

I am pleased to report that this year has been a relatively calm period for the Friends of the Hurtwood, after the impact of the COVID period. In the face of rising costs many members had generously increased their donations, the CollecTin in the Peaslake shop has been a success and a number of events have raised funds including the Peaslake Fair. We have had to replace the Ranger’s truck, which had given good service. We have also been actively seeking a new barn for the Ranger’s equipment and hope to conclude an agreement shortly.

As the refreshed financial section of the report will show, the Friends of the Hurtwood has a strong balance sheet, despite expenditure running above income. However, in terms of operating revenue and expenditure, like many charitable organisations today we are experiencing the double pressure of increased cost of living impacting on the level of donations we receive and inflation increasing our running expenses.

Reserves

Our legacy reserves had long been invested in funds designed by the Charities Aid Foundation. This service was withdrawn during the year and we moved our investments to Charles Stanley where we now hold a portfolio of bonds and equities. The balance is deposited in National Savings Income Bonds and our Unity Trust Bank account. During the year the total return on all reserves was just short of £7,900.

The Directors of the Corporate Trustee are confident that these reserves are adequate for a charity of our size.

Risk

The Risk Register is updated regularly to take account of the changing nature of the environment of the Hurtwood (e.g., trail erosion, forestry works), the potential for conflict between different users (e.g., fast moving bikers and horse riders), financial risk and various other issues (e.g., fly tipping and fire risks).

The Directors of the Corporate Trustee have reviewed the updated risk register and are satisfied that appropriate and proportionate action is in place to mitigate the risks identified.

Acknowledgements

A list of the members of the charity during the year is included elsewhere in this report. Also included is a list of business and organisation sponsors. During the year we also received donations from our Landowners and Grants from Local Authorities.

We would like to thank everyone for their continued support during the year being reported and, extend a warm welcome to all those who have joined us since the year end.

In closing, I would like to record my personal thanks to the independent directors and landowner directors who have been so supportive. I would also like to thank my management team whose work is invaluable.

Finally, I cannot sign off without mentioning Mark, our Ranger and the most important person in FotH. Mark is willing to tackle almost any job on the Hurtwood and always knows someone who can provide more resource or machinery when needed.

Operations Report

We’ve had a slightly quieter year on the Hurtwood than normal, possibly due to a rather damp summer. Unfortunately fly tipping continues as usual, including asbestos again this year. Asbestos is very costly to remove and continues to be a financial drain on our budgets that we have to bear in order to provide car parks for our visitors. Car park surfaces have also been repaired where necessary, and is part of our ongoing maintenance schedule.

We’ve had many trees down this year and as usual I try to get the ones blocking paths removed and the paths open again as quickly as possible. Occasionally we will need to use outside contractors to help with this. We’ve cleared the main section beside the cemetery track in Peaslake to return some of the views, as well as clearing the view from No.1 car park on Holmbury Hill. We have also carried out work to widen fire roads by cutting undergrowth, to help prevent the risk of fires spreading.

Notes to the financial statements

Basis of accounting

The accounts have been prepared under the historical cost convention with items recognised at cost or transaction value unless otherwise stated in the relevant notes to the accounts.

These accounts have been prepared in accordance with:

the Statement of Recommended Practice: Accounting and Reporting by Charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS102) issued on 16 July 2014,

and with the Financial Reporting Standard applicable in the United Kingdom and Republic of Ireland (FRS 102 1A) and with the Charities Act 2011.

Change of accounting policy

The accounts present a true and fair view and the accounting policies are those outlined in this note.

Going concern

There are no material uncertainties about the charity's ability to continue.

Changes to accounting estimates

No changes to accounting estimates have occurred in the reporting period.

Material prior year errors

No material prior year errors have been identified in the reporting period.

Funds

Unrestricted funds represent the funds of Friends of the Hurtwood that are not subject to any restrictions regarding their use and are available for the general purpose of the trust. Funds designated by the Trustees for a particular purpose are also unrestricted.

Restricted funds consist of monies received for specific purposes. The unspent balances of the funds may not be used for any other purposes unless the Trustees have received, from the donors, express permission to do so.

Designated funds are unrestricted funds where the Trustees have resolved to set aside the funds for a specific purpose.

Designated Legacies Reserve is an unrestricted reserve that the trustees have set aside to fund projects consistent with the Charity’s objectives or that will enhance the efficiency of the Charity.

Recognition of income

Income is included in the Statement of Financial Activities when the charity becomes entitled to the resource, it is more likely than not that the trustees will receive the resource and the monetary value can be measured with sufficient reliability.

Independent Examiners Report to the Trustee of Friends of the Hurtwood

I report to the directors of the charity trustee on my examination of the accounts of the charity for the year ended 31[st] October 2023 which are set out on pages 6 to 11.

Responsibilities and basis of report

As the directors of the charity trustee you are responsible for the preparation of the accounts in accordance with the requirements of the Charities Act 2011 (‘the Act’).

I report in respect of my examination of the charity’s accounts carried out under section 145 of the Act and in carrying out my examination I have followed all the applicable directions given by the Charity Commission under section 145 (5) (b) of the Act.

Your attention is drawn to the fact that the charity has prepared the accounts in accordance with Accounting and Reporting by Charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and the Republic of Ireland (FRS 102) in preference to the Accounting and Reporting by Charities: Statement of Recommended Practice issued on 1 April 2005 which is referred to in the extant regulations but has since been withdrawn.

I understand this has been done I order for the accounts to provide a true and fair view in accordance with Generally Accepted Accounting Practice effective for reporting periods beginning on or after 1 January, 2015.

Independent Examiner’s Statement

I have completed my examination. I can confirm no material matters have come to my attention in connection with the examination giving me reason to believe that in any material respect:

  1. Accounting records were not kept in respect of the charity as required by section 130 of the Act; or

  2. The accounts do not accord with those records; or

  3. The accounts do not comply with the applicable requirements concerning the forma and content of the accounts set out in the Charities (Accounts and Reports) Regulations 2008 other than any requirement that the accounts give a ‘true and fair view’ which is ot a matter considered as part of an independent examination.

I have no concerns and have come across no other matters I connection with the examination to which the attention should be drawn in this report in order to enable a proper understanding of the accounts to be reached.

Appendix

  1. Name : Friends of the Hurtwood

  2. Constitution : The Trust is an unincorporated association registered as a Charity. The objects are contained in the Constitution adopted on December 6th 2000 and varied since that date. Copies will be available at the Annual Meeting if any Members wish to see one.

  3. Charity Number : The registered Charity Number is 200053.

  4. Members of the Trust : Membership is open to any person over the age of 18 who supports the objects of the Charity and subscribes or makes donations to the Charity on a regular basis or who otherwise applies to become a Member of the Charity.

  5. Address : The address of the Charity and the name of the Secretary and Ranger appear on the back of the Annual Report.

  6. Bankers : Unity Trust Bank plc, Nine Brindley Place, Birmingham, B1 2BR.

  7. Restrictions : There are no restrictions on the way in which the Trust operates nor are there any specific investment powers.

  8. The Trust’s objects: Set out in the Constitution, are to administer the public rights of access to land on the Hurtwood placed by landowners within the Trust's control. The policies adopted by the Trust to further the objects are explained in the reports from the Chairman and Ranger.

  9. Trustee and management : The sole Trustee is FOTH Trustee Company Limited. The names of its Directors appear on page 13. The Articles of Association of the trustee company provide for a maximum of 18 Directors, comprising 4 Landowner Representative Directors and 14 Independent Directors. The affairs of the Trust are controlled by the Trustee, whose Board meets at least twice a year.

  10. Management Committee : During the year the executive authority rested with the Chairman's Committee which supervises the activities of the Secretary and Ranger, a full time executive post. At the date of the Annual Meeting, the Chairman’s Management Committee comprises Mr A Collins (Chairman), Mr D Clifford, Mr W A Don (Treasurer), Mrs Z Horton, Mrs J Kumar, Mrs N Loates-Taylor, Mr A MacKinnon, Dr G Wyss.
