The Trustees present their report together with the financial statements of Gerry’s Pompeii for the period ended 31 December 2022.
Structure, governance, and management
a. Constitution
Garry’s Pompeii is a Charitable Incorporated Organisation, and was registered by the Charity Commission on 12 May 2022. It is a first set of accounts and comparative figures are not applicable.
b. Methods of appointment or election of Trustees
The management of the charity is the responsibility of the Trustees who are elected under the terms of The Constitution.
c. Organisation
The Board of Trustees, which comprises of 3 Trustees, is the governing body of Gerry’s Pompeii. It is responsible for overseeing the management of the Charity.

Objectives and activities
a. Policies and objectives
The charity's objectives are to advance public appreciation of and education in the arts for the public benefit by providing access to the artistic work of the late Gerald Dalton (1935 - 2019) at the northwest London site popularly known as ‘Gerry's Pompeii’.
b. Activities for achieving objectives
The activities of the charity were work closely with its local community and wide range of supporters to protect and uphold what remains of Gerald Dalton’s work and to create public access to this important cultural resource.
c. Public benefit
In setting objectives and planning for activities, the Trustees have given due consideration to general guidance published by the Charity Commission relating to public benefit, including the guidance 'Public benefit: running a charity (PB2)', and this report seeks to comply with that guidance by clearly explaining and illustrating how the charity delivers public benefit.

d. Risk assessment
The Trustees have assessed the major risks to which the charity is exposed, in particular those related to the operations and finances of the charity, and are satisfied that systems and procedures are in place to mitigate the charity's exposure to major risks and undertakes to review these risks and controls each period.
Achievements and performance
a. Activities
The trustees confirm that sufficient funds were raised which were used to start campaign to preserve Gerry’s artworks.
b. Review of charity's financial position for the period
The results for the period are set out on page 6. The income for the period was £26,560. The expenditure for the period was £3,500 which in turn reduces the reserves carried forward to £23,060.
Financial review
a. Going concern
After making appropriate enquiries, the Trustees have a reasonable expectation that the charity has adequate resources to continue in operational existence for the foreseeable future. For this reason, they continue to adopt the going concern basis in preparing the financial statements. Further details regarding the adoption of the going concern basis can be found in the accounting policies.
b. Reserves policy
The Trustees consider it prudent to maintain an adequate level of unrestricted reserves to provide funds which can be designated for specific charitable purposes.
Trustees' interests
The Trustees may claim for reasonable expenses incurred in undertaking the objectives of Gerry’s Pompeii but in this case, they do not receive any expenses, remunerations or other financial benefit. The Trustees have confirmed that they do not have and have not had any beneficial interest in any contract with the company.

Trustees’ responsibilities statement
The Trustees are required by law to prepare financial statements for each financial year which give a true and fair view of the state of affairs of the Charity as at the end of the financial year and of the surplus of the Charity. In preparing those financial statements the Trustees are required to:

Select suitable accounting policies and then apply them consistently;

Observe the methods and principles in the Charities SORP;

State whether the applicable accounting standards have been followed, subject to any material departures disclosed and explained in the financial statements;

Make judgements and estimates that are reasonable and prudent; and

Prepare the financial statements on the going concern basis unless it is inappropriate to presume that the charity will continue its work.
The trustees are also responsible for maintaining proper accounting records which disclose with reasonable accuracy at any time the financial position of the Charity and which are sufficient to show and explain the Charity’s transactions and enable them to ensure that the financial statements comply with the Companies Act 2006 / Charity Act 2011, the Charity (Accounts and Reports) Regulations 2008 and the provisions of the charity’s constitution. They are also responsible for safeguarding the assets of the charity and hence for taking reasonable steps for the prevention and detection of fraud and other irregularities.

The Trustees consider that the charity is entitled to exemption from the requirement to have an audit under section 144 of the Charities Act 2011 and that members have not required the charity to obtain an audit. The Trustees acknowledge their responsibilities for complying with the requirements of section 130 of the Charities Act 2011 with respect to accounting records and the preparation of accounts.

1. General information
Gerry’s Pompeii is a charitable organisation incorporated in England and Wales. The registered office is Gometra House, Ulva Ferry, Isle of Mull, PA73 6NA.
2. Accounting policies
2.1 Basis of preparation of financial statements
The financial statements have been prepared in accordance with the Charities SORP (FRS 102) - Accounting and Reporting by Charities: Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) (effective 1 January 2019), the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) and the Companies Act 2006.
Gerry’s Pompeii meets the definition of a public benefit entity under FRS 102. Assets and liabilities are initially recognised at historical cost or transaction value unless otherwise stated in the relevant accounting policy.
The financial statements are prepared in sterling, which is the functional currency of the company.
Due to the liquid reserves in the balance sheet, the trustees have identified no material uncertainties that may cast a significant doubt over the ability of the company to continue as a going concern.
2.2 Income
All income is recognised once the charity has entitlement to the income, it is probable that the income will be received and the amount of income receivable can be measured reliably.
All incoming resources are recognised in the Statement of Financial Activities, on page 6, when received ensuring no advance credit of monies are taken and to reflect prudent accounting practice.
2.3 Expenditure
Resources are dealt with on an accruals basis and are analysed as detailed on the Statement of Financial Activities. Where costs have not been directly attributable to a particular category, they have been allocated to activities on a basis consistent with the use of the resources.
Charitable activities and Governance costs are costs incurred on the charity's operations, including support costs and costs relating to the governance of the charity apportioned to charitable activities.
2.4 Fund accounting
The financial statements of a charity must differentiate between restricted and unrestricted funds.
General funds are unrestricted funds which are available for use at the discretion of the Trustees in furtherance of the general objectives of the charity and which have not been designated for other purposes.
Restricted funds are funds which are to be used in accordance with specific restrictions imposed by donors or which have been raised by the charity for particular purposes. Trustees have confirmed that there have been no restricted funds received in this period.

By the nature of its principal activities, the company is a non-profit making charity and because of this, a Profit and Loss Account is not included in these accounts, being replaced by a Statement of Financial Activities.

Annual Report
The Board of Trustees presents its report and Unaudited Financial Statements for the year to 31st December 2022. The trustees confirm that the Annual Report and Financial Statements comply with the current statutory requirements, the requirements of Gerry’s Pompeii’s governing document and the Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic and Ireland (FRS102).
The trustees review the aims, objectives and activities of the charity each year. The review helps the trustees ensure these remain focused on its stated purpose. We refer to the Charity Commission's guidance on public benefit when reviewing our aims and objectives and in planning future activities. This report reflects on our first achievements and the outcomes of our work in the period: May – December 2022.
What is Gerry’s Pompeii?
For over 30 years, Gerard ‘Gerry’ Dalton (1935-2019) worked privately, creating hundreds of artworks and transforming his unassuming ground floor flat, garden and the adjoining bank of the Grand Union canal into an extraordinary and singular visionary environment. This was the parallel world of an intensely private extrovert. Although Gerry was well known by his neighbours and was a loving presence on his street, the full extent of his work was only uncovered following his death in 2019.
Following a nationwide campaign to save it initiated by friends and neighbours, Gerry’s home was transferred back to Notting Hill Genesis Housing Association in 2020. What remains is the extensively decorated 50-metre wall and garden with hand-hewn topiary and the 50 sculptures that Gerry created along the canal bank on land originally leased by the Canal and River Trust to Gerry’s neighbours. This public artwork can be viewed from the towpath on the opposite side of the canal.
Gerry’s Pompeii CIO
Gerry’s Pompeii CIO has developed out of the energy, support and excitement for Gerry’s work, which was galvanised by the public campaign. The campaign highlighted a need to save and champion heritage sites by artists that are often marginalised and revealed the need for a more centralised visual arts space to serve the communities in North Paddington where Gerry’s Pompeii is situated. Gerry’s Pompeii CIO is an ambitious new organisation that will build on and seek to share Gerry’s legacy. It will inspire creativity by working closely with its local community and a diverse range of supporters. As a charitable incorporated organisation, it will protect and uphold Gerry’s work on the bank of the Grand Union Canal and work towards creating greater public access to this inspiring site and important cultural resource. Our long-term vision is to create an alternative visual arts space for the area and we are currently developing a playful programme that will involve a wide range of activities such as: workshops, boat tours, processions, alternative happenings and imaginative antics that are delivered in Gerry’s spirit.
In our first year, 2022, we spent time developing the extensive and diverse networks built and engaged during the campaign and talking to more experts, specialists, supporters and allies that might join Gerry’s Pompeii more formally as part of the advisory group or board of trustees, bringing their knowledge and skills to support our vision and mission and helping us to develop future strategy. These conversations usually start with an informal tour of Gerry’s Pompeii and tea offered by neighbours, Nick and Alison whose house we walk through to access the garden.
We have been carrying out regular informal meetings (and teas) with neighbours of Gerry’s from Hormead Road to understand, on a hyper-local level, what people would like to see from an organisation like ours. We have also been participating in many productive and exciting conversations with a wide range of local groups and potential partners, supporters and experts about more ongoing collaborations to help further build our case to local authorities and
funders. Community consultation and collaboration is at the heart of our ethos and central to how we will develop our work in future.
Activities: May –December 2022
Preparation for debut screening of documentary films: ‘Gerry’s Pompeii’ by Stella Scott and ‘Pompeii’ by Jacek Zmarz and Louis Harris White. December 2022
During 2019-2020, two films were made by independent filmmakers inspired by Gerry’s work. Filmmakers Jacek Zmarz and Louis Harris-White made a short film with footage of Gerry’s Pompeii in its totality, including words by Gerry previously transcribed by his neighbour Roc Sandford. This is now a vital record of Gerry’s work. From 2019-2022, filmmaker Stella Scott shot footage of Gerry’s Pompeii and captured the local community around it. She interviewed Gerry’s neighbours, documented the site, recorded the campaign journey and investigated the poignant mystery of what inspired the maker of this magical place.
In December 2022, Gerry’s Pompeii CIO prepared for the debut screening of these films for invited guests which took place at The Kiln, a local theatre that supports films documenting marginalised stories in an area that has strong ties to the Irish community. The aim of the event was to platform the film to industry as well as supporters of the campaign, tell the story of Gerry’s Pompeii and raise funds for our programme in 2023.
A pre-screening of the documentary with people from Hormead Road (where Gerry lived) was held at Roc Sandford’s house on Hormead Road. We wanted the people who featured in the film and those that knew Gerry to have an opportunity to see it first. The evening was very moving with 25 people attending. As it closely followed Covid-19, this was a wonderful and welcome event that brought people from the local community together to reflect on a journey in which they felt a combination of nostalgia and pride. Feedback was also gathered which Stella Scott took on board before making final edits to the film.
Architectural Association collaboration: December 2022
Bricoleurs on the loose: Useful follies for Gerry’s Pompeii
As part of their “Bricoleurs on the loose” module, 20 BA students from the Architectural Association were invited to visit Gerry’s Pompeii. They received their brief that was co-written by Sasha Galitzine (Director of Gerry’s Pompeii) and the Heads of their course, in which Gerry’s Pompeii was pitched as their ‘first client’. The students were asked to design ‘useful follies’, dividing into groups to take consider subjects such as weather, access, care and health & safety.
Part way through the project, a critique was held in which Sasha Galitzine, Nick Hall (Interim chair) and Alison Sage (Gerry’s neighbour) attended with several architectural critics and practitioners as well as their tutors and gave feedback on how the projects might be developed further. The students came up with a range of brilliantly creative ideas and architectural models that were presented as part of their end of year showcase. This was attended by a large public audience over a number of days.
One of the aims for this collaboration was to provide an opportunity for learning about Gerry’s Pompeii as an important, alternative heritage site and a real-life example of the type of clients the students might encounter in the future. It enabled Gerry’s Pompeii to develop new relationships with architectural experts and expand its network. This project also allowed us to pilot a project with an institutional partner in education. We plan to develop this further and proactively seek partners who are interested in Gerry’s Pompeii as a site for education and learning.

City & Guilds of London Art School collaboration: Ongoing with a focus on 4th, 11th, 18th October 2022
Conservation report: case study
15 second year students from the BA course at City & Guilds of London Art School visited Gerry’s Pompeii in October 2022 as part of a case study project in which it was treated as a site for conservation. The students met with Gerry’s Pompeii’s gardeners and carried out an assessment together, discussing how conservators and gardeners could work together to best conserve the site. They must work in tandem to ensure the artworks can be properly preserved.
One of the aims for this partnership was to provide an opportunity for learning how a site like Gerry’s Pompeii might be conserved. It provided the students access to a real-life, active site in which they could carry out investigations. Gerry’s work incorporates a very diverse and unusual range of materials and is therefore ripe for innovative study. This partnership enabled Gerry’s Pompeii to further develop its relationships with conservation experts and expand its network.
As well as offering the students an opportunity to learn, their work contributed to a high quality conservation report that was given to Gerry’s Pompeii pro-bono. This provided the foundation of a conservation report that Gerry’s Pompeii will continue to develop, re-visit and monitor on an annual basis.
Gardening and Maintenance
Since Gerry’s death the garden has been maintained by his neighbours. In 2022, more gardening experts were consulted. We have begun planning what sort of gardening plan needs to be in place, considering both its conceptual principles and practical points on maintenance so that we can ensure the garden looks its best and does not lose its integrity.
Operations & Funding sources
In 2022, Gerry’s Pompeii researched and devised a detailed budget and fundraising strategy for its forthcoming activities We raised funds through one major private donation (the Kathleen Hannay Memorial Charity).
Gerry’s Pompeii has sound administrative and accounting procedures: billing, filing, payments etc. The Director is responsible for the day-to-day execution of these activities. In order to ensure additional transparency and accountability, annual accounts and accounting records are reviewed by an external examiner each year.
Reserves Policy
Gerry’s Pompeii’s Reserves Policy is revised annually by the board of trustees. Reserves are held in order to protect the charity against unexpected drops in income or allow it to take advantage of new opportunities. Reserves can only be spent with the approval of the Board of Trustees.
