## **25[th] OCTOBER 2022** ## **TRUSTEES REPORT** As per the GROUP decision made at the Zoom meeting of Thursday the 7[th] of December 2020 the Trustees resigned our GROUP from the BPSA and initiated the GROUP application to the Charity Commission to be registered as a CIO. 1[st] Blackwater Valley B-P Scout Group was duly entered into the Register of Charities as a CIO on the 21[st] of January 2021 with the charity number 1193176. Our Charity is governed by our CIO constitution which has been sent out to all members at the time of registration. That constitution enables our GROUP to operate under its bye Laws. The development of Bye Laws is ongoing but the main framework is in place. Some Unit programmes, progress work, and achievement recognition is still to be completed as are a couple of policies. The Trustees have pursued funding for a new Scout Hut building through Your Fund Surrey (YFS). Our first application was rejected despite a meeting at the Scout Hut with fund administrators. A second application has been accepted and is through to the second stage and at the time of writing is confirmed “still live” by YFS. However, we have a short period of grace to prove that a new Scout Hut for our GROUP would provide ‘adequate’ community benefit. A petition of potential licensed use for mental health and older person’s organisations will be submitted shortly. After various meetings a Pre-School Group were given generous licence issued on the 1[st] of December 2021 by our GROUP to use our premises and that turned out to be a significant mistake resulting in the GROUP deciding to serve notice upon the Pre-School Group at the extraordinary meeting held via Zoom on Tuesday the 14[th] of June 2022. Subsequent to an email from the owner and manager of the Pre-School Group confirming that she was passing defamatory comment regarding our GROUP to parents locally and claiming that the Pre-School Group should be the only users of our Scout Hut the Trustees agreed that such wilful harm to the GROUP business could not be ignored or tolerated and issued a letter of Foreshortened Notice on the 28[th] of September 2022. The final decision was based on balancing the established fact of defamation with the possibility of legal action by the licensee when the very generous license agreement was indeed no longer viable due to the aggressive acts of that very licensee. There was a criticism of the Trustees for taking such a decision that might expose the GROUP to legal action. In any case, a GROUP meeting by Zoom on Friday the 7[th] of October voted to positively respond to an entreaty by Surrey County Council (SCC) to allow the Pre-School to stay the original period of notice for the sake of the children and families involved. Correspondence through SCC enabled the GROUP to elaborate on the reasons for the original Notice and the Foreshortened Notice to SCC. Discussions through SCC established that all further communications between our GROUP and the Pre-School Group would be through SCC offices.
