The 'no recoL¢rse to public lund5' INRPFI policy exacerbates poverty, Inequality and dlscrimin3tion and should end. Whlle
it continues, and as part of our Wofk to end it. we support people to remove the NRPF condition from their leave to
remain. We run weekly casework sesslon5 every Tuesday where we provlde appolntments and workshops for people wlth
NRPF to help make'chan8e of condltions, appll£ations for recourse to public funds. Thls means that people access the
welfare safety net In tlmes of crisis or hardship. We provldÈ Èmer8ency Materlal supplies for people lacin8 destitullon io
ensure they can get by while they are awoltln8 an outcome to their application. We a150 pursue Idstin8 policy change and
strateBlc Iltl8atlan whEre ne¢essary. We traln, superylse, 5UPPOrt and learn frDm a team of empathetic and dedlcated
C3sework volunteer5. rnany ol whom have experienced the system first-hand, to become more elfectlve In thls work and
future related work.
We are the only orK•nlsatlon In the UK that speclflcally a5515ts wlth the complex Immlgratlon appllcatlon needed to saln
acces5 to publlc fund5 and we ha¥e an excellent reputation for this work.
Recent e5tlmates say that at least 1.4 mllllon people in the UK have NFIPF.

In 2020, 11,432 people applled to have the NRPF condltion removed.
This represents a 350% increase on the number of appllc?tions In 2017118 vthen records be8an.
However. It still represent5 less than 1% ol the total number of people with NRPF.
Only 80% of these applicarlons will be successful.

ACHIEVEMENTS AND PERFORMANCE
Casework
We make complex irnrni¢ration applications with and lor people who are facinB abject poverty and hDmele5sness to
emove the NRPF condStlon.
In 2020, we submitted 99 successful applScatSon5 for recourse to public funds and additSon, we have supported
103 appllcant5 to make thelr own applications this Is more thèn double the number o13pplicaliL)ns that we
rnade 2019, though Still a drop in the ocean compared io the need.
We had a 100% success rate in 2020. Please note that, a$ our only criteria for referral Is Immigratlon status, we
take on a number of very cornplex cases which are Included In rhis succe55 rate.
Over 80% our relerrals are self-referrals, which rnalnly corne through word-of-mouth recommendation5.
We have increasingly received referra15 frcm across the UK, including Scotland. Wales and Northem Ireland,
wh5ch Illustrates the extent of the Issue ané the lack ol available odvice.
Where people experienced delays, we sent pre-actign letters to the Wome Office to chase these up- we sent over
20 01 these in 2020 and these èpplicatlons recelved p051tive deE1510Th5 Wlthin a week. We also sent over 50 letters
to MPS about the delays.
We worked with acclaimed publi¢ law flim Delqhton Pierce Glynn IDPGI to start various Strategic challenies in
several cases In¥olvSng unlawful Home Ofllce decislon-maklng. We have now wor*Ed wlth DPG to Start le8al
acrion in alm05t ca5e5 On several legal grounds, includ5n8 discrimination, impact on children and de13VS.
We have been unable to provide lunch and chlldcare during the pandemic, but we worked wlth Hackney MSgrant
Centie, food bank5, Little Villa8e and local mutual ald 8roups to tsffer all appllcant5 erner8ency support. Includln8
advising over 50 people about access free school meals and lssuln8 hundred5 of food bank vouchers.
In each ¢aSE, we s18npost applicants to advlce and support Iram trusted partners on related issues, whlch Include
but are not Ilrnlted to applltatlons for extensloTh of leave, Ch51d 8enefit entltlement, chlldcare entltlement, NHS

Success In tho H*h Court
We took the governrrent to couri wlth DPG In May 2020 and won the case. A5 a result. part of the policy was ruled
unlawful. You can read rnuch more abobt thi5 and lind Ilnks to news Coverage on our web51te. In response, the policy has
been chan8ed to allow people who ère Ilkely to become destltute to apply to rernove the NRPF condition. The court
challenge and the 8overnrnent'5 defeat was a hugely important Step. and a bi8 feat for a tlny orlanisation Ille OUT5.
This follows the case we brought lastyear120191 whlch forced the government to revlew the NRPF pollcv.

When TUP started back in 2017, less thah 350 people made 'change of conditions, applicèt10ns every 3 months, there was
a 62 day delay for detlsions, and only a 41% success rate, according to recently published 8overnment data. After our first
court Case in February 2019, and the review of the poliry thot it prompted. the success rzte jumped up to 79%. There •re
lots of factDfs behlnd these chaThges, aThd they are stlll noi enough, but we are &lad to have played our part in them.
After years ol lobbylni, the Horne Offlce In 2020 also released data about the a8e, ethnicity and Eender ol people maklng
'chan8e of conditions. appllcatlons. The statistics tonfirm the untenable di5crlmlnaiory Impaci of ihe policy, irnpactln8
severely on people of colour. and women In particular.
We have set-up a Working fjrouplcoalitipn on NRPF Involving over 100 or8anis3tlons across the UK to coordlnate what
has become a multl-014ani5ation, cr05S-sector push to challenge and overturn the NRPF policy. We are part ol the Horne
Offlce-led'NRPF Forum,, whlch was establlshEd In response to the Windrush scandal to improve procedure amd practlce.

has had much more attentlon sn the medla and In parllament. In partlculaf In relatlon to the IltlÉatlon that we have

We have been workin8 wlth MPS such as Stephen Tlmm5, who notably ralsed NRPF wlth Borls johnson In Mav.
We wrote brielin8S that were relled on in the debate on NRPF In October and a 8lack History Month debate In
October. and we contlnue to work w5th MPS to 8ather data relatin8 to the policy from a relucianr Home Office.
NRPF has been raised as an issue hundreé5 of times this year. wlth MPS jolnin8 our ta115 to Scrap the policv.
As well as providing briefings, we have been 5peakin8 to relevant media. responding to revlews, and 5peakin8 In
parllament. Intluding at APPG events and roundtables.
We provided training to over 70 MP caseworkers in Oeiember 2020.
NRPF has received weekly media attentlon over the past year. We have spoken to several journallsts, where we

Increase our operatlng budget and thus wll increase the need lor u5 to secure new lundinA.
We therefore consSder St prudent to maintaln unre5trlcted reserve5 equatSn8 to 3 months of our operatln8 budget. Thls
would ensure, In the event ol a fundln8 shcrtlall or unexpected expendlture. the tontlnued actlvlty of the charlty. Our free
ieserves at 31$t December 2020 equated to £76,513. Given projected annual expenditure of £154.375 for the 2021
flnancial year thi5 amounts to just under 6 ffjonth5 of unrestrlcted reserves. The trustees are therelore 5at15fSed that
sufficient rE5erve5 are available arsd that. through the bud8et5 and funding plan5 Put in place lor the forthcomin8 yea¥,
unre5trlcted reserve5 will be expended and brouiht down to a level closer to that expected t*y the charlty's pollcles.

155ue 15 only likely lo become more pronounced In the coming years. It is essential that there 15 an organ15ation focussed
on thls issue and Is able to carry out 5peclallst servS¢e dellvery, evldence gaiherlng, IItIBatlon and advocacy to reform it and
io help those affected.
In the lorthcorning yeaf we antlcipare 8rants to remaln our maln source of fundin8. Arnong the uncertainties we face in
2021 Is how the on8olnB pandemlc and it5 effects will change the fundin8 land5¢ape. We will also be required to continue
evaluatin8 how we undertake our work and to make adjustments as necessary in the face of lockdown5 and other reloted
re5triction5. GSven thls. we will continue to carefully evaluate our budget and fundin8 tareets throughout the year and
seek to establish sustainability for the charsty through securing new multi-year grants.
