2.1 Type of Governing Document
The Charity's constitution is based on the Charity Commission's model governing document for
Foundation Charitable Incorporated Organisations (CIO), ie.. where the Trustees are the only
Members of the charity.
2.2 Charitable Objects
The charity's objects are."
l) For the public benefit the conservation, preservation, protection and improvement of the
physical and natural environment, in particular through the establishment and maintenance of a

community orchard in Week, Broom Park and the surrounding area which supports a diverse
ecosystem and is species-rich.
2) To promote for the benefit of the inhabitants of Week, Broom Park and the surrounding area the
provision of facilities for recreation or other leisure time occupation of individuals who have need of
such facilities by reason of their youth, age, infirmity or disablement, financial hardship or social and
economic circumstances or for the public at large in the interests of social welfare and with the
object of improving the well-being of the said inhabitants.
2.3 Trustee Selection Methods
There must be at least three charity trustees but there is no maximum number.
In accordance with the Constitution, Trustees are appointed or re-appointed for a term of one year
by a resolution passed at a properly convened meeting of the charity trustees.
Trustees are all volunteers drawn from the local community and in the process due consideration is
given to ensuring that the Trustees have, between them, the skills and experience necessary to
manage the charity effectively and in accordance with charity law.
Activities
3.1 Statutory Declaration
The trustees can confirm that they are fully aware of the guidance on public benefit and have taken
it into account when making decisions. The trustees consider that the provision of the orchard is
highly beneficial to the public and provides opportunities for exercise and relaxation in a safe space.
Achievements & Performance
4.1 Outputs and Outcomes for the Charitvs Beneficiaries
This year we purchased a sit on mower. Previously we have relied on employing contractors
to cut the grass which is expensive, can only be done twice a year and never gave us the
flexibility to manage the grassland. Thanks especially to David Williams, the mower has
been a huge success and ensured that we can mow at the appropriate levels and at the right
time to encourage wild flowers and wildlife.
Sadly, it was decided that the Monterey Pine on the top boundary of the orchard needed to
come down. These trees grow at such a rate and to such a height that they can cause
problems and can be dangerous. It is hoped that the wood can be used later for benches or
small table.
The apple crop was tremendous this year and we had fourjuicing sessions which as ever
were really good fun.
We had so many apples that we made a number of donations to the local food bank and we
are intending that we will continue to do this in future years as the trees get larger and
more productive.
In December we produced our annual calendar filled with orchard photos.
4.2 How the Public have benefitted
The orchard provided a peaceful breathing space for leisure time which has been well-used
and much appreciated by the entire community.

The majority of the apple trees are heritage varieties and on the whole are Devon and
Cornwall varieties. The trees, which are labelled and cross referenced on our orchard
noticeboard, give people the opportunity to recognise and learn about local varieties.
The provision of community events and volunteering opportunities
The provision of opportunities for working and learning new skills to maintain and enhance
the natural environment and protect wildlife.
4.3 Volunteers
In September of this year one of the founding members of the Community Orchard, Chad, died.
The current trustees and the orchard owe a huge debt of gratitude for his contribution over the last
13 years and he will be sorely missed.
Trustees and other volunteers have contributed significantly to the maintenance of the orchard in
many ways, including:
Scything, raking and composting hay from the meadow.
Pruning the fruit trees.
Mowing the grass paths.
Repairing and maintaining fences and gates.
Harvesting rods from the willow bed and maintaining the living willow structures.
Providing the administrative and financial support needed to maintain the orchard and the
charity.
The Trustees wish to thank all those volunteers who have continued to look after the trees and the
land with such care and thought for one another. Volunteers are vital to the existence and
functioning of the orchard and give a lot of time and energy to managing all aspects of the Charity.
4.4 Membership
The local community comprises roughly 90 households and in 2025 50 of these were full members
of the orchard. The members provide the core funding for the orchard maintenance costs on an
annual basis and also offer their time and expertise in the management of the orchard and charity.
A new estate of houses is currently being developed next door to the orchard and we are planning
in 2026 to invite the new householders to become members and possibly have some kind of
welcome event for them all.
5. Financial Review
5.1 Details of Any Funds Materially in Deficit
The Charity has no funds which are materially in deficit.
5.2 Policy on Reserves
The Charity's policy on reserves is to generate and maintain a balance which is sufficient:
a) to preserve the financial viability of the Charity in the event that unforeseen and/or
unavoidable circumstance precipitates a short-term fall in its income.
b) to ensure we have a sizeable fund to cover unforeseen expenses arising from the maintenance
of the orchard.
c) to enable the Charity to have funds which can be used to develop new projects to enhance the
value of the orchard to the community.

For these purposes the Charity will endeavour to generate and maintain reserves which are at least
100% of its annual turnover.
5.3 Principal Sources of Funding and Outgoings
There are three main sources of income for the Orchard- membership subscriptions, grants and
donations. Since we became a charity we are also able to claim gift aid where applicable which has
helped to increase income.
The change of status to a CIO in 2020 also puts the Orchard in a good position to apply for grants in
the future to increase the environmental benefits and facilities. This year we have received £1,000
from Dartington Parish Council which has primarily been used to purchase the mower. The trustees
are truly grateful for this support and would thank all those involved in these decisions.
We also have a grant from DEFRA amounting to £176 which a contribution to our management of
the wildflower areas.
The main areas of expenditure are rent paid to Dartington Trust, public liability insurance and
maintenance costs- for example grass mowing and collecting, replacing trees and maintaining
fences.
5.4 Remuneration of Trustees
All Trustees act in a voluntary capacity and receive no remuneration or other material benefits from
their services to the Charity.
Out-of-pocket expenses for small items such as mower fuel or printing costs incurred by Trustees in
promoting the purposes of the Charity are reimbursed at cost.
5.5 Financial Status
Though modest, The Orchard's current resources from unrestricted donations are more than
sufficient to meet its outgoings for at least next year. Following the mower purchase we will no
identify a specified reserve of £400 pa in order to purchase a replacement when necessary.
All the indications are that this will remain the case for the foreseeable future.
5.6 Statutory Statements on Liabilities
The Trustees declare that:
O The charity has given no guarantees where potential liability under the guarantee is outstanding
at the date of this statement (eg." any outstanding/ongoing contract or legal undertaking to buy
or provide specific services);
O The charity has no debt outstanding at the date of this statement which is owed by the CIO and
which is secured by an express charge on any assets of the CIO.

5.8 Notes to the Accounts
a) Accounting Policies
The financial statements have been prepared in accordance with the Charities Act 2011
Section 133, using the Receipts and Payments basis available to small charities and the
charity's own Accounts Spreadsheet.
b) Reimbursement of Out-of-Pocket Expenses
Out-of-pocket expenses incurred necessarily, reasonably and incidentally in the course the
charity's activities are reimbursed at cost.
c) Salaries & Professional Fees
No trustee receives any payments for the services they provide to the charity.
In the current financial year the charity employed no staff.
d) Fixed Assets
The charity has not purchased or disposed of any fixed assets in the current financial year.
e) Rounding Discrepancies
All amounts are recorded to the penny, but in these accounts are shown as digitally rounded
to the nearest pound. This can occasionally result in a total apparently not being the sum of
its constituent amounts. All individual amounts, and their totals, are nevertheless correct.s
