As reported previously, draft agreements were sent to Newquay Town Council who forwarded to their solicitors. By 31st March 2024 no agreement had been reached.

During May 2024 the trustees had several meetings with their solicitors trying to progress matters. In June 2024 a meeting was held between two trustees and Newquay Town Council to discuss the sticking points, and it was considered this was a successful meeting. It was hoped agreement would be completed by September. However, by the end of July still no word had been received from the council’s solicitors.

Unfortunately, the situation dragged on until mid-November 2024 when the CEO of Newquay Town Council sent an email to say there was one small amendment to be made which was minor. A month later the Trusts solicitors were sent a new draft with extensive amendments, some concerning items that had already been agreed!

Two trustees had a further meeting with the Trusts solicitors on 18th December 2024, and the solicitors responded to the Councils solicitors on 19th December 2024. Another 3 months were lost because of staff holidays and sickness (we were advised) at Newquay Town Council. On hearing nothing from the Council or its solicitors the Trustees wrote on 22[nd] January to the CEO of the Council expressing disappointment at the slow progress, although the trustees were assured that the project was receiving constant and due attention. Sadly however, there was no evidence of such and at 31[st] March 2025 the legal agreements needed were still outstanding.

Although the Trustees had high hopes that this project would be finalised by the Spring of 2025, our hopes were dashed by the slowness of Newquay Town Council and its solicitors.

Postscript

The Deed of Gift was signed later in 2025 and it is now hoped that building the base for the Surf Statue will start in late January 2026, with the statue being erected in Spring 2026.

I report to the trustees on my examination of the accounts of the above charity (“the Trust”) for the year ended 31/03/2025.
