For the period ending 5-4-25
The opening balance brought forward from last year is £36,328.91
Income amounted to £135.00
During this reporting period there has been minimal fundraising activities. This is due to ongoing discussions with the land owners (Chelmsford Diocese) see below
Expenditure amounted to £11.25
This expenditure was for the hire of Great Tey Village hall for an AGM.
There were no claims for reimbursement of trustee’s expenses during this financial year.
The closing balance carried forward at 5-4-25 is £36,452.66
Legal Position
Following the meeting at Chelmsford Diocese on 9/4/24 where issues over the Heads Of Terms legal agreements to use the land for the purposes of rebuilding the community pool were discussed, the Diocese gave their position that they could not agree to the legal heads of terms. Further consideration was offered by the Diocese to look at working within the constraints of Charity law for the Diocese as trustees. This was followed up by further correspondence from the Diocese on 6/6/24 where they informed us that they had to stick to their position of not agreeing to the heads of terms and they could not support the legal requirements that the pool committee needed to progress the project
Following the Diocese position the pool committee reached out to the local community to ask for any other potential land that could be available for the pool project, none has been forthcoming. We also reached out to the community to ask if anyone would like to step forward to take the roles of Chairperson, Treasurer or Secretary to take the project further, nobody has come forward to take on these positions.
The Pool Committee then considered our position, after discussion and following charity commission guidance decided that we needed to ask the committee members to vote on whether they wished to proceed with the project (which will be subject to new members coming forward) or to Stop/Close the project, close the charity and take the necessary steps to return funds (where possible) or redistribute funds, according to charity commission rules.
The Committee members voted to Stop/Close the project and work towards winding up the project, returning donations and following Charity Commission guidance.
