Brookfield Spaceplace (1084435) currently leases the building we operate within from Preston College on a long-term lease until March 2025. It is the aim to transfer the lease to Brookfield Spaceplace CIO (1158546). **Summary of the main activities undertaken for the public benefit in relation to these objects (include within this section the statutory declaration that trustees have had regard to the guidance issued by the Charity Commission on public benefit)** We have been acting under advice from a lawyer and a consultant throughout the process – from establishing the CIO to the timing of transfer assets. The advice included choosing the new structure in order to give the trustees the added protection of a legal entity for holding the lease to the building. Working with a lawyer and a consultant we wrote to the college after the CIO had been registered with the Charity Commission but had heard nothing from them at 31 March 2015. In December 2015 the lawyer dealing with this matter has confirmed that the college is prepared in principle to provide consent for the transfer of the lease but proposed to produce a formal Licence to Assign. The college is asking Brookfield Spaceplace to meet its legal fees of £750 plus vat for dealing with the licence to assign. We have agreed to pay these costs and at the date of this report are waiting for the document to be produced, we are hoping that this will be any day now, as due to an administrative error our file was archived at Preston College for a number of months.
