## **REPORT OF THE TRUSTEES FOR THE YEAR ENDED 31 MAY 2022** 

The trustees who are also directors of the charity for the purposes of the Companies Act 2006, present their report with the financial statements of the charity for the year ended 31 May 2022. The trustees have adopted the provisions of Accounting and Reporting by Charities: Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) (effective 1 January 2019). 

## **OBJECTIVES AND ACTIVITIES** 

## **Objectives and activities** 

The charity's object contained within the memorandum and articles of association is to foster the safety of and maintain an effective rescue service for the assistance of any human being, animal or boat of any nature in peril from the sea in  the area of the estuary of the River Leven / Ulverston Channel / South Channel in the county of Cumbria. 

The charity is governed by its committee of trustees who are directors of the company and who appoint officers responsible for the management of the charitable activities. 

The trustees confirm that they have complied with their duty under section 4 of the Charities Act 2006 to have due regard to the public benefit guidance published by the Charity Commission and consider that the pursuit of the association's aims through the activities described above is consistent therewith. 

## **Origins and aim** 

Following the tragic death of Stewart and Adam Rushton by drowning on January 5th 2002, at a meeting of Ulverston Town Council on February 11th a call was made by Cllr J W Prosser to take whatever action was possible to prevent repetition of such a happening, including the creation of a local rescue facility. It was decided to call a meeting of all interested parties and this took place on March 7th, chaired by the Mayor of Ulverston, Cllr Mrs M Hornby. 

About 30 people were present including representatives of the Town Council, Parish Councils along the east side of Furness Peninsula, South Lakeland District Council, Cumbria County Council, Cumbria County Constabulary, H.M. Coastguard, The Environmental Agency, Morecambe Bay Fishermen's Association, Duddon Inshore Rescue, and Bay Hovercraft Rescue (Grange over Sands). 

The meeting decided to set up two groups, one to undertake a feasibility study for the establishment of a rescue facility and the other to deal with immediate practical issues such as warning signs, access ramps, navigational aids and dangerous structures in the sands. 

In the event the two groups merged into one and held five meetings, chaired by Cllr Prosser (and attended by Cllrs J Jenkinson and H S Lewis in their personal capacities only), the last one being held on October 9th, at which stage so much progress had been made towards the formation of Ulverston Inshore Rescue that it was felt that the combined group had completed its task and would not be required to meet again unless some unexpected problem arose.

## **Early History** 

By October 9th 2002 a rescue team had been established and were meeting regularly, a step by step capability programme had been drawn up with the team's advice, the necessary accommodation for crew and equipment had been identified and a source of supply at reasonable cost had been found, negotiations started for a suitable site, arrangements discussed with H.M. Coastguard locally and a Constitution for an Association drawn up which should satisfy the Charity Commissioners when seeking Charity status. The declared object was: 

"To foster the safety of and provide and maintain an effective rescue service for the assistance of any human being, animal or boat of any nature in peril from the sea in the area of the estuary of the River Leven / Ulverston Channel / South Channel in the County of Cumbria." 

The Constitution and Business Plan were adopted on October 31st 2002 at the first meeting of the Management Committee and the officers appointed - Chairman J W Prosser, Secretary Mrs J Jenkinson, Treasurer H S Lewis (all acting in personal capacities and not as councillors). The representatives of the rescue team were B Chattaway (Station Officer) and Mrs S White. The representatives of the fund-raising team were P Hornby and T Irving. The ex-officio member was N Bishop-Rowe (deputy Mayor of Ulverston) and the remaining member was N Parker (Chairman of Morecambe Bay and Fishermen's Assoc). Messrs Prosser, Parker and Lewis were deputed as a sub-committee to  forward arrangements. Arranged in this way the only official representative of the Town Council was the deputy Mayor and although we have received much help from them (such as in photo-copying) we are not an organ of the Town Council. 

At the second Management Meeting, on December 2nd 2002 it was agreed, that we should first become a Company Limited by Guarantee, which would mean that we had some protection in the event of litigation. At the same meeting it was decided to join The Royal Life Saving Society which would automatically give Public Liability Insurance. A site plan for an enclosure, containing a Crewroom and three steel containers, was agreed for negotiation with GlaxoSmithKline who were to provide a site near to Canal Foot. 

Meetings took place (separately) with the landowner and the local Planning Officer in which our preferred arrangements were agreed. On March 4th 2003 full Planning Permission was granted. By the end of April the landowner had repaired the access ramp down to the beach, and by the end of September 2003 the fenced enclosure, generously provided by the landowner (including free electricity, water and connection to mains drainage), was completed. In the meantime the crewroom and two 20ft containers had been placed in position and put into use for training purposes, and by the end of the following month the third (30ft) container had been purchased and installed. 

On May 9th 2003 we were incorporated as a Company Limited by Guarantee (No.4759588), on January 16th 2004 we became a Registered Charity (No.1101567) and on July 20th 2004 we were granted permission to drop "Ltd" from our title. 

Meanwhile training of the rescue team continued to the required standards in all the necessary skills, such as First Aid Certificates, Radio Operator Certificates etc. Various training sessions on beach search and elementary boat handling took place with H.M. Coastguard (Barrow In Furness). On Sunday February 11th 2004 we had a liaison visit from a rescue helicopter of "A" Flight, 202 Squadron, RAF Boulmer. Unfortunately we heard later that that unit was to be closed down. 

Equipment purchased for a crew of fourteen included High Visibility Personnel Protective Equipment, lifebelts, high power torches for night operations, two Quad Bikes and VHF Marine radios (personal sets and sets for the base and Quad Bikes). Having received authorisation, all these sets were fitted with H.M. Coastguard dedicated Channel 0. Call-out pagers were obtained on hire. 

The Quad Bikes were equipped with road lighting gear and put into use for beach patrol and beach search purposes, fitted with containers for First Aid equipment etc. 

During 2003 it came to our notice that a Draft Code of Practice for Rescue Boats was under consideration by H.M. Coastguard, with which any new organisation would have to comply. A copy was obtained together with the information that it was expected to be finalised and issued in the autumn of 2003. This meant that it seemed unwise to purchase either the small boat or the larger boat contemplated in our Business Plan (even if we had the money) until that action took place. A new document entitled "2nd Draft" and dated July 16th 2004 was received, but by May 31st 2008 no final document had been issued.

## **OBJECTIVES AND ACTIVITIES** 

In an emergency, H.M. Coastguard (now Maritime and Coastguard Agency or MCA) will call upon available voluntary organisations, previously approved, if they seem appropriate for the task in hand. Those which comply with extremely onerous conditions are called "Declared Facilities" and those which meet less onerous conditions are called "Additional Facilities". A detailed examination of the Draft Code, which applies only to Declared Facilities showed that in our circumstances it was virtually impossible to meet some of the clauses and therefore, reluctantly, a policy decision was taken to aim only at Additional Facility status. 

Towards the end of 2004 our attention had been drawn to a small surf rescue boat which had a shallow draught, of which at least 30 were in use by the RNLI, produced by Arancia Industries Ltd of New Zealand. In the circumstances we decided to purchase one; it was delivered in July 2005 and proved to be very useful in shallow waters, in a limited area and in daylight hours only. It was named "Fisher 1". 

During the latter part of 2005 and early 2006, investigations into a larger (but still small draught) boat confirmed that it was not possible to obtain one which would be suitable for our accommodation and local conditions and at the same time comply with the Draft Code. The decision was taken that we would only aim at Additional Facility status for the new vessel but would comply, as nearly as we could, with the Draft Code. After an intensive search a manufacturer was found whose boat was close to the Draft Code requirements. The boat selected was a rescue version of the Humber 5.9m Assault RIB manufactured by Humber Fabrications (Hull) Ltd, was fitted with VHF radio, GPS, depth sounder and navigation lights and was capable of carrying up to 11 people. The new boat (named "Lady Maria" at the request of the donors) was collected from Hull in August 2006 and safely installed in the 30ft container. 

In September 2006 a Ford Ranger 4 x 4 vehicle was purchased for towing the "Lady Maria" to the various launching points along the coast and to act as a mobile base during rescue operations. Initially this vehicle was stored outside the enclosure of the Rescue Station, but that was clearly unsatisfactory. 

Fortunately, the enclosure was enlarged at no expense to ourselves thanks to the generosity of the landowner. As a  result of further grants from various bodies and individuals we were then able to sell one of the old containers and purchase two new (10 ft wide) thermally insulated containers. These were suitable for accommodating the "Lady Maria" and the 4 x 4, and the installation was completed in November 2006.

## **ACHIEVEMENT AND PERFORMANCE** 

## **Incidents** 

During the year Ulverston Inshore Rescue were called out twenty two times including providing 1st aid and marshalling cover. Incidents included the following:- 

23/6/21 paged at 21.27. Reported missing person on Walney Island near Roundhouse. 

Multy agency task force including Barrow Lifeboat and Duddon Inshore Rescue. Thorough search by all teams but nothing found. Police later found individual on land safe and well. Good team effort. 

24/6/21 Paged at 7.11 this morning along with Furness Coastguard. Reported person in trouble at Priory Point Ulverston. Person turned out to be a shrimper. False alarm with good intent. 

26/6/21 21.49 paged by HM Coastguard. Reports of person cut off by incoming tide at Plumpton viaduct. Team met with Police on west side of the viaduct. Person could be seen located to east of the viaduct and was recovered by Arnside coastguard. Person was checked and found to be safe and well and made it back to shore. Again a good team effort. 

4/7/21 Called direct by member of the public. Car stuck on beach. U I R responded and towed the vehicle to safety. 

16/7/21 Paged by H M Coastguard Holyhead together with Barrow Lifeboat and Furness Coastguard. Person reported to be clinging to an inflatable at Roosecote. Second person entered water in attempt to rescue first. Both managed to get back to shore. The inflatable drifted out to sea and was recovered by Barrow Lifeboat. Considered by Coastguard to be a very close call which could have ended differently. 

17/7/21 Paged at 18.26 along with Duddon Inshore Rescue,Millom Coastguard and Barrow Lifeboat. Rescue 936 Helicopter also in attendance. Concerns were raised for a lone swimmer last seen at Bigger Bank. Multi-agency response and a co-ordinated search was organised. Police then found missing man walking home! 

25/8/21 Three people plus dog reported to be caught out by the tide at Bardsea. U I R paged at 14.00 together with Barrow Coastguard. People were located and found to have returned to shore. 

29/08/21 Ulverston to Chapel Island over the sands. U I R provided emergency support including two Rescue Quads. No incidents this year. 

18/9/21  Keswick to Barrow walk. Ulverston Inshore Rescue requested to provide marshalling and 1st aid cover. 

19/9/21 Marshalling at the Fred Whitton cycling challenge. Emergency transport provided if required. No incidents this year. 

4/10/21 Requested to assist in the search for a 14 year old boy missing from home. The Rescue Station was used as a command centre by Coastguard and Police to co-ordinate a search of the coastline. 9 crew attended, Coastguard very pleased with Ulverston Inshore Rescue. 

5/11/21 Swimmer in fear of drowning spotted by our SubStation Officer out at sea off Barrow in Furness. With the help of a member of the public with a kayak, he managed to get to the drowning man and kept him afloat until the RLNI arrived. Well done to everyone. Life saved.  ( N W Evening Mail) 

6/11/21   High tides and flooding. U I R out on patrol to assist any stranded motorists etc. 

2/12/21 Storm Arwen. U I R requested to attend Blue Light Hub Ulverston. Together with Police, Fire Service, Ambulance, U I R visited residents in outlining areas affected by loss of power to check on their welfare and provide meals etc.. This continued for several days. 6/12/21 Electricity still off in some outlying areas including Witherslack. ( B B C North West) 

30/12/21 16.30 callout by Furness Coastguard to assist in search for woman lost on marsh at Greenodd. Rescuers located women just in time as her phone ran out. Good outcome which could have turned out much worse. Arnside Coastguard also in attendance.

24/1/22 Called out by H M Coastguard Holyhead. Missing person at Grange having attempted suicide the day before. Vehicle found with suicide note inside. Search took place for an hour before being stood down. Person found at Blackpool. 

27/3/22 Callout by H M Coastguard Holyhead. Concerns for a missing person last seen walking along the promenade of Walney Island. Search parties included Coastguard, RLNI and Ulverston Inshore Rescue as requested by Police. Missing person located by Police safe at home. Debriefing with coastguard and RLNI. 

30/3/22  1500 hours callout by H M Coastguard Holyhead. Reported missing person. 

U I R to meet Furness Coastguard at Cavendish Dock Barrow in Furness. Police proceeded to search train line while  sea search took place. Reports that missing person was seen on Foulney Island. U IR transported a member of the Police and the casualty was found.  Great result. 

10/4/22  Called out at 21.20 by H M Coastguard Holyhead.. Reported persons on beach at Bardsea. False alarm with good intent 

11/4/22 Called out at 02.45 by H M Coastguard Holyhead. Report of missing person on Walney Island. Person found and U I R stood down on way. 

7/5/22  K2B marshalling. no incidents reported 

8/5/22  Ist Aid cover and marshalling Fred Whitton Challenge. No incidents 

## **FINANCIAL REVIEW** 

## **Financial position** 

In spite of the effects of Covid on our finances, we continue to be financially viable and we are able to meet our overheads going forwards. 

## **Reserves policy** 

The trustees have not declared a reserves policy. All of the company's tangible fixed assets were acquired by specific fundraising and any subsequent assets would only be acquired by further fundraising. Operating expenses are met from ongoing annual fundraising. 

## **STRUCTURE, GOVERNANCE AND MANAGEMENT** 

## **Governing Document** 

The charity is a private company limited by guarantee. Each trustee is a member of the company. The members have guaranteed the liability of the company to a limit of £1 each. 

The company was incorporated on 9th May 2003 and the governing document is the company's Memorandum and Articles of Association.

The directors are appointed by the directors other than: 

a) one ex-officio director who is the Mayor or Deputy Mayor of the town of Ulverston, Cumbria nominated by Ulverston Town Council

## **Independent examiner's report to the trustees of Ulverston Inshore Rescue ('the Company')** 

I report to the charity trustees on my examination of the accounts of the Company for the year ended 31 May 2022. 

## **Responsibilities and basis of report** 

As the charity's trustees of the Company (and also its directors for the purposes of company law) you are responsible for the preparation of the accounts in accordance with the requirements of the Companies Act 2006 ('the 2006 Act'). 

Having satisfied myself that the accounts of the Company are not required to be audited under Part 16 of the 2006 Act and are eligible for independent examination, I report in respect of my examination of your charity's accounts as carried out under Section 145 of the Charities Act 2011 ('the 2011 Act'). In carrying out my examination I have followed the Directions given by the Charity Commission under Section 145(5) (b) of the 2011 Act. 

## **Independent examiner's statement** 

I have completed my examination. I confirm that no matters have come to my attention in connection with the examination giving me cause to believe: 

1. accounting records were not kept in respect of the Company as required by Section 386 of the 2006 Act; or 2. the accounts do not accord with those records; or 

3. the accounts do not comply with the accounting requirements of Section 396 of the 2006 Act other than any requirement that the accounts give a true and fair view which is not a matter considered as part of an independent examination; or 

4. the accounts have not been prepared in accordance with the methods and principles of the Statement of Recommended Practice for accounting and reporting by charities (applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102)).

The charitable company is entitled to exemption from audit under Section 477 of the Companies Act 2006 for the year ended 31 May 2022. 

The members have not required the company to obtain an audit of its financial statements for the year ended 31 May 2022 in accordance with Section 476 of the Companies Act 2006. 

The trustees acknowledge their responsibilities for 

- (a) ensuring that the charitable company keeps accounting records that comply with Sections 386 and 387 of the Companies Act 2006 and 

- (b) preparing financial statements which give a true and fair view of the state of affairs of the charitable company as at the end of each financial year and of its surplus or deficit for each financial year in accordance with the requirements of Sections 394 and 395 and which otherwise comply with the requirements of the Companies Act 2006 relating to financial statements, so far as applicable to the charitable company. 

These financial statements have been prepared in accordance with the provisions applicable to charitable companies subject to the small companies regime.

## **1. ACCOUNTING POLICIES** 

## **Basis of preparing the financial statements** 

The financial statements of the charitable company, which is a public benefit entity under FRS 102, have been prepared in accordance with the Charities SORP (FRS 102) 'Accounting and Reporting by Charities: Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) (effective 1 January 2019)', Financial Reporting Standard 102 'The Financial Reporting Standard applicable in the UK and Republic of Ireland' and the Companies Act 2006. The financial statements have been prepared under the historical cost convention. 

## **Income** 

All income is recognised in the Statement of Financial Activities once the charity has entitlement to the funds, it is probable that the income will be received and the amount can be measured reliably. 

## **Expenditure** 

Liabilities are recognised as expenditure as soon as there is a legal or constructive obligation committing the charity to that expenditure, it is probable that a transfer of economic benefits will be required in settlement and the amount of the obligation can be measured reliably. Expenditure is accounted for on an accruals basis and has been classified under headings that aggregate all cost related to the category. Where costs cannot be directly attributed to particular headings they have been allocated to activities on a basis consistent with the use of resources. 

## **Tangible fixed assets** 

Depreciation is provided at the following annual rates in order to write off each asset over its estimated useful life. 

Buildings - 10% on cost Shipping properties -   15% on cost and 10% on cost Plant and machinery - 15% on cost Computer equipment - 33% on cost 

## **Taxation** 

As a charity, Ulverston Inshore Rescue is exempt from tax on income and gains falling within sections 472-477 of the Corporation Tax Act 2010 or section 483 of the Corporation Tax Act 2010 to the extent that these are applied to its charitable objects. No tax charges have arisen in the Charity. 

## **Fund accounting** 

Unrestricted funds can be used in accordance with the charitable objectives at the discretion of the trustees. 

Restricted funds can only be used for particular restricted purposes within the objects of the charity. Restrictions arise when specified by the donor or when funds are raised for particular restricted purposes. 

## **Gifts in kind and voluntary help**
