The trustees who are also directors of the charity for the purposes of the Companies Act 2006, present their report with the financial statements of the charity for the year ended 31 March 2023. The trustees have adopted the provisions of Accounting and Reporting by Charities: Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) (effective 1 January 2019).

Activities 2022-2023

During the year, we have undertaken a number of initiatives to make sure we deliver our strategic objectives and work towards fulfilling our mission. These include:

ACHIEVEMENT AND PERFORMANCE

The following sections for achievements and performance and financial review form the strategic report of the charity.

Achievements and performance

Case advocacy

OPAL received in excess of 150 referrals for personal advocacy support during the year. Referrals came from a wide range of sources: individuals themselves, health and social care professionals and family members. Delivery continued as normal throughout the year, with work being carried out in person and remotely when appropriate and convenient for the client. Demand for advocacy support for parents with learning disabilities requiring intensive support when dealing with children's services means that we currently have a number of people on a waiting list.

Learning Disability Engagement Events

OPAL received funding to facilitate monthly engagement sessions on key health topics. Feedback was obtained from people with lived experience and carers and provided to the council to develop and better services in Oldham. We ran sessions on:

OPAL's Women's Group

The women's group continued to run throughout the year, providing a safe, welcoming space for women to meet and make friendships, seek guidance on matters that concern them about themselves or their families and have fun! OPAL received funding to run a programme focusing on increasing physical activity and improving mental health. Women's group members participated in weekly sessions from October 2022 to the end of March 2023. Sessions included:

Feedback was positive, with members continuing with some activities at home.

Learning Disability Friends project

We want Oldham to be an inclusive town where people with learning disabilities and autistic people feel welcome and able to play an active part in the community. Our Learning Disability Friends project aims to help community groups in Oldham to feel confident and welcome people with a learning disability and autistic people.

This year, the sessions were revised and co-produced with members of our services who helped to make videos to incorporate into the presentation.

Your Day Your Way

OPAL staff worked hard to continue delivering excellent service following the effects of the Covid-19 pandemic. Virtual Zoom sessions were on stand-by if the service ever needed to go virtual, but this was not the case.

Members took part in fundraising for OPAL with 'STEPtember'. As OPAL will celebrate 40 years of service in 2023, members wanted to take on the challenge of walking 40 miles throughout September, raising £1000.

The OPAL Crew

The OPAL Crew continued to run successfully, with lots of great sessions planned within Oldham and the wider community. Members have enjoyed exciting educational trips out, completed courses, developed skills and had fun. The staff team continued to network and build positive relationships with community groups.

Hate Crime Awareness

OPAL is a third-party hate crime reporting centre and supports inclusiveness through a range of activities funded through Oldham Council.

Learning Disability Health Trainer Programme

OPAL continued with its learning disability health trainer programme this year, offering individuals free 8-week sessions to increase physical activity and reduce the effects of loneliness and isolation caused by COVID-19. Throughout the 8 weeks, individuals were encouraged to set and achieve goals. The trainer would work with them to identify ways to reduce any distress caused by the pandemic, develop confidence and overall help to improve their mental wellbeing.

FINANCIAL REVIEW

Financial position

The total income for the year was £263,812 (2022:£300,564). The main source of income for the charity is now generated through Your Day Your Way but essential funds continue to be received to support advocacy and placements from

FINANCIAL REVIEW

Reserves policy

To achieve the reserves target, the Board has continued scrutinising expenditure and ensuring that all activities are properly funded.

The Board has implemented the priorities identified in the extensive review of the reserves policy and documented in the Strategic Plan for 2019 to 2024. Activities supported this year include the women's group.

Reserves are the result of the charity's unrestricted income fund, which are freely available to spend on any of the charity's purposes. The Board have reviewed all unrestricted income streams and assessed these in respect of the future continued funding; the net profile of the income stream and the impact of the loss of each income stream.

The above systematic identification of risk and future income and the assessment of committed expenditure to each stream of income has enabled the board to assess for each income stream the reserves needed to manage risks identified, shortfalls in income and specific liabilities identified, including loss of key staff and redundancy.

The above reserves which have been identified total £85,000 and will continue to be recognised in the financial statements as continuity and contingency reserves. Additional reserves will be referred to as general reserves.

Reserves will be reviewed at Board meetings when the quarterly management reports are received. Performance against budget will be monitored. The reserves policy will be reviewed and revised annually to reflect any changes in the operating context of the charity. Activities funded through the general reserves will be monitored to ensure the work remains relevant to members and can demonstrate impact.

FUTURE PLANS

In 2023, OPAL will be celebrating 40 years of supporting people with a learning disability and autistic people in Oldham.

We know how challenging the past few years have been due to the pandemic and the impact this has had on many of our day service members and advocacy clients. Many people with a learning disability lost social skills and social contact due to Covid-19, which greatly impacted their mental health.

Over the past year, OPAL has seen its fair share of changes, including a new chief executive, the start of a new alternative day service and the growth of its staff team. Everyone has worked hard with a focus on Covid-19 recovery and getting back to 'normal'. We have received funding from a variety of sources, including commissioned work, grants, individual budgets and generous donations.

We want to continue providing our members with activities based on their interests while researching additional opportunities. OPAL employees are skilled workers who can adapt their practice to support individual health and support needs.

Staff and trustees took part in a development day, along with member feedback, which helped us highlight key priorities for the next five years. This was a very successful day, identifying exciting new ideas for OPAL's future. Our strategic plan is made up of three priorities: increasing membership number, activities and co-production.

STRUCTURE, GOVERNANCE AND MANAGEMENT

(a) Structure

Oldham Personal Advocacy Limited (OPAL) is a charitable company limited by guarantee and was founded in 1983. It is governed by memorandum and articles of association, which were last amended in 1998.

The charitable objects are to promote the relief of people with learning disabilities to obtain their full rights and privileges as citizens, to provide such people with personal friendship and support and also promote the relief of unemployment for the public benefit in such ways as may be thought fit.

(b) Board Members

Additional Board skill gaps identified at annual review will be promoted on an ongoing basis with local partners and using social media.

(c) Management

The Board have adopted systems of internal control that are designed to provide reasonable, but not absolute, assurance against material misstatement or loss. These include:

OPAL employs a Chief Executive, who is accountable to the Trustees and is responsible for the day to day management of the charity.

The directors have identified the risks which have the potential to effect reserves and have created a current risk register for the charity. The risk register will be subject to rigorous and focused review during 2022/23. Having identified these risks the Board have implemented systems to recognise, evaluate and mitigate the risks.

Independent examiner's report to the trustees of Oldham Personal Advocacy Limited ('the Company')

I report to the charity trustees on my examination of the accounts of the Company for the year ended 31 March 2023.

Responsibilities and basis of report

As the charity's trustees of the Company (and also its directors for the purposes of company law) you are responsible for the preparation of the accounts in accordance with the requirements of the Companies Act 2006 ('the 2006 Act').

Having satisfied myself that the accounts of the Company are not required to be audited under Part 16 of the 2006 Act and are eligible for independent examination, I report in respect of my examination of your charity's accounts as carried out under Section 145 of the Charities Act 2011 ('the 2011 Act'). In carrying out my examination I have followed the Directions given by the Charity Commission under Section 145(5) (b) of the 2011 Act.

Independent examiner's statement

Since your charity's gross income exceeded £250,000 your examiner must be a member of a listed body. I can confirm that I am qualified to undertake the examination because I am a member of the Association of Chartered Certified Accountants, which is one of the listed bodies.

I have completed my examination. I confirm that no matters have come to my attention in connection with the examination giving me cause to believe:

  1. accounting records were not kept in respect of the Company as required by Section 386 of the 2006 Act; or 2. the accounts do not accord with those records; or

  2. the accounts do not comply with the accounting requirements of Section 396 of the 2006 Act other than any requirement that the accounts give a true and fair view which is not a matter considered as part of an independent examination; or

  3. the accounts have not been prepared in accordance with the methods and principles of the Statement of Recommended Practice for accounting and reporting by charities (applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102)).

I have no concerns and have come across no other matters in connection with the examination to which attention should be drawn in this report in order to enable a proper understanding of the accounts to be reached.

1. ACCOUNTING POLICIES

Basis of preparing the financial statements

The financial statements of the charitable company, which is a public benefit entity under FRS 102, have been prepared in accordance with the Charities SORP (FRS 102) 'Accounting and Reporting by Charities: Statement of Recommended Practice applicable to charities preparing their accounts in accordance with the Financial Reporting Standard applicable in the UK and Republic of Ireland (FRS 102) (effective 1 January 2019)', Financial Reporting Standard 102 'The Financial Reporting Standard applicable in the UK and Republic of Ireland' and the Companies Act 2006. The financial statements have been prepared under the historical cost convention.

Income

All income is recognised in the Statement of Financial Activities once the charity has entitlement to the funds, it is probable that the income will be received and the amount can be measured reliably.

Expenditure

Liabilities are recognised as expenditure as soon as there is a legal or constructive obligation committing the charity to that expenditure, it is probable that a transfer of economic benefits will be required in settlement and the amount of the obligation can be measured reliably. Expenditure is accounted for on an accruals basis and has been classified under headings that aggregate all cost related to the category. Where costs cannot be directly attributed to particular headings they have been allocated to activities on a basis consistent with the use of resources.

Taxation

The charity is exempt from corporation tax on its charitable activities.

Fund accounting

Unrestricted funds can be used in accordance with the charitable objectives at the discretion of the trustees.

Restricted funds can only be used for particular restricted purposes subject to restrictions declared by the donor or through the terms of the appeal.

Pension costs and other post-retirement benefits

The charitable company operates a defined contribution pension scheme. Contributions payable to the charitable company's pension scheme are charged to the Statement of Financial Activities in the period to which they relate.
