The Tst further aim5 to provide for the growing social. educational and welfare needs of local youths and of all members of the community in general. Islam - An Eternal Wiy of Life Islarn is mor¢ than just a religion - it is a complete way of life and to follow it is to follow a definitive de of ¢onducL Not only does Islamic legislatil relate to belief and worship. bul also for a Muslim, ALLAH SWT has a150 divinely ordoined the economic and social 85pects of his or her life. Therefore, it ts imperativ¢ for a Mu51irn, regardless of his plac¢ of r¢sidence. that not only does he live in accordance with the law of the land in which he r¢sides, but that he abidL¥ by ihe dictates of Islami¢ law. (Shariah law) as well. Musllm Brltln The rising Muslim population of the United Kin8dom has naturally Te5ulted in the Muslims encountering many social problem$. panicularly on the dO[n¢1¢ front. Furthermore, it was ascertained that the vast majority of ihese problems temmed from ignorance to th¢ Islami¢ rules and regulations regarding malas¢ and divorce. It was therefore decided after consvliotion, to forni a 'Coun¢il for Shariah Research. comprising of a body of Scholars. This was set up in early 1994 in Dewsbury. West Yorkshire, and is tirelessly continuing its servic¢ ro the Muslim public io the present day. In recognizing its urgeni neal and importance, the f8¢ts Speak for thun5clvcs; to this date, over 7} Lases hav¢ had the benefit of having been given a clear legal ruling by the CnCil for Shariah ReSe3h - only ALLAH SWT knows how many mor¢ have not. The Need for * Shrl*h Council A civil marriage in Britain requires a man and a woman io accept each other in ihe TresenLe of two witnesses in the Registr8rfs OtTice, whether ihey have conducted an 151amic malage (Nikahl is immatLrial. Similarly. a civil divorce requires the peiitioner Ihu%band OR wife) to filL' d divorLe pelition at court with the Judgc finalising the divorce with a dLcree absolute. It is worth nuling thgt thc l•w% ot'LiviI marriage and divorLc arc appli¥ablL' to all rcsidcnrs of ihc Unit¢d Kingdom. irrespectiv¢ of ih¢ir SLX. colour. r#¢L or rcligious persu8$ion. Islamic Shariah requires a man or woman to acLCPt L¥Lh other as husband and wife in froni of iwo sane, mature men or one m8n and two women. Howevu. unlikc Briiish Livil law. Islam has grdntcd the righi of Talaq to the rnan with the woman b¢ing grnnied th¢ right lo scck Khula - both are procedure5 for tcrniinating the Islamic marriage. In the event of the right5 Ot ihe woman bcing abused or if she is being subjectol to IK)th physical and psychological abuse, then domestic life becomes unbeardbl< and in the words of the Quean. Ihe judgement of a Don-muslim judge is often not binding according to Islamic Shariah law und the woman still requires the judgement of & Qadhi to declare her Ma1age annulled, clearing the way tiir hLT to legally remary. ISLAMIC RESEARCH INSTITUTE OF GREAT BRITAIN REPORT OF THE TRUSTEES FOR THE YEAR ENDED 31 MARCH 2024 OWECTIVES AND ACTIVITIES Objeetives and &irn5 Indeed, there are many similarities between English and Islamic family law. One such exampl¢ is ihc law relating to eusiody of the child. According to English law, both parents who have been parties to a malage retain parental re5pon5ibility of the child, until the child reaches majority. which in English law is the age of18. Islami¢ law says the same. wilh the only difference being that Islamically the child reaches majority when he or sh¢ r¢aches the age of puberty. Another exa2nple of the fact that both legal systems share the same principles and ihat they ¢an th¢refore co-exist is in relation to the very important issue of reconciliaiion. In English law, solicitors have a duty to investigate any possibility of recon¢ili81ion, by way of mediaiion facilities if necessary. They should be alive io the possibilily that the purpose of thc visit to the solicitor may not b¢ to octually to obtain a divorce. but to impre55 upon the other party to mend his ways by forcing upon him ihe realisation of what will happen if he doe5 not. Similarly. when a case is brought 10 th¢ Shariah Council. after initially notifying both parties thai the Shariah Council is irbvolved, both parties are invited to atterjd and participate in a meeting where ihey can discuss the relevant 155ues and th¢ possibility of reconcilia(ion. There are many similarities and ways in which the two legal systems can co-exist, but for the sake of bmity, we have meniion¢d only two. Reeo2nxtion An important sign thai rh¢ work c8rri¢d out by th¢ Shariah Council is widely recognised is shown by the nuinber of cases thai ar¢ r¢f¢ffed io u5 by women's group5 and forums. Furtherniore. w¢ are now g¢rting mor¢ and more leiiers from solicitors acting for partie5, asking us to help resolve the issue5 of an unsuccessful marriage Islamically, and in conjunction with English di¥(Kce proceedings. Addirionally. individuals wilh dual or foreign n8tioDality are increasingly relying on our documentation io support various Islamic maiters of life at embassies and ¢onsulaies of Mu51im-Inajority countries.
